BILLING TERMS

These Billing Terms (hereinafter referred as “Billing Terms”) are supplementary to our Terms and Conditions and is Part of the Agreement between you and MBK in relation to the Program and services we provide through MBK’s Website/App/Forum and your use of it. The capitalized terms used in these Billing Terms has the same meaning as defined in the Terms and Conditions part of this Agreement.

1. Subscriptions and/or purchases of the Services of MBK conducted via the website or by the in-app purchasing system are subject to the Terms and Conditions and this Billing Terms of the Agreement

2. Subscriptions can only be purchased either directly from the MBK Website (Website online purchase system); or Via the MBK App (In-App purchasing system).

3. You are under the obligation to pay the subscription fees irrespective of your usage or access to MBK’s Services, unless you have terminated your subscription by virtue of clause 23 of this Billing Terms.

In-App Purchase

4. The In-App purchases are made via an external Application store in your mobile or cellular or Tablet or any other similar devices. These purchases will be conducted and handled by the relevant Application Store and will be billed by them respectively. Therefore, all In-App Purchases will be subject to the terms and conditions and other licensing arrangements specified by that relevant Application Store service provider.

6. You understand and agree that the your In-App Purchase(s) are processed securely via the payment gateway used by the relevant App Store provider; and that MBK bear no liability or responsibility regarding any loss or damage or injury incurred as a result of your In-App purchase from the relevant Application Store, as MBK takes no part in the transaction between You and the Application Store. Further, any issues that may arise regarding payment for your In-App purchase or with an In-App Purchase or return requests, you shall contact your Application Store provider directly.

Website Purchase

7. All transactions made directly from the Website are managed and billed by us. These purchases are processed securely via our third-party payment gateway providers (Payfort).

8. All transactions are handled over SSL and are PCI-Compliant. We do not store your credit card details which will be stored by Payfort.

9. Refunds will be done only through the Original Mode of Payment.

Payment

10. In the absence of any free trial period, payment must be made at the time of purchase and before you have access to your subscription.

11. On the MBK app, the (1) one, and three (3) month(s) Subscriptions are payable up front in lump sums at the commencement of the Subscription.

12. The twelve (12) month subscription, may be available, payable in monthly instalments over a twelve (12) month period is only available on the website. The price of those monthly instalments will vary by region. 

13. Subscriptions will be auto-renewed on the first day of the beginning of your next billing period unless you expressly indicate to us you do not wish to renew as per section 9.1 of the Terms and Conditions.     

14. It is absolutely necessary on your part to notify us of any change to your method of payment (“Payment Method”) or if your payment or card details have changed.

15. We will assume your Payment Method is correct and will continue to bill Subscription Fees and charges relating to your Subscription by your nominated Payment Method:

(a) If any Subscription Fees billed to your account are not processed for any reason we may suspend your Subscription until payment is made in full.

(b) We reserve the right to vary the Subscription Fees from time to time, but only for the next and subsequent billing periods. In that event we will give you reasonable notice of the variation before it will come into effect; and

(c) If you do not cancel your subscription before your next billing cycle, you will be deemed to have accepted the variation (with reference to clause 9.0 of the Terms and Condition)

Free Trials

16. Your Subscription will start with a free trial for a fixed period of (7) seven days.

17. Free trials are only available to new users, and are at our sole discretion, and if you attempt to sign up for an additional free trial, you will be immediately charged with the standard Subscription Fee.

18. We reserve the right to revoke your free trial at any point of time without any prior notice.

19. Unless you cancel your subscription before the end of the free trial period, your free trial will expire and you will be charged the Subscription Fee for (1) one month.

20. Any unused portion of your free trial period will be forfeited upon purchase of a subscription.

Promotions

21. We may offer special promotions, trials, discounts, offers or coupons from time to time directly through the Website or through third parties, subject to and on its terms and conditions separate to those of our Terms and Conditions. It is your responsibility to read and understand those third party terms and conditions.

22. Any trial offers or subscriptions will automatically rollover to a paid subscription unless cancelled at the end of the promotional period, or unless otherwise stated.

Cancellation

23. Unless you cancel or opt out of automatic renewal of your subscription before the expiry of your Subscription, you will be charged for a renewed Subscription in the same amount of your initial Subscription the day your initial Subscription expires.

24. After cancellation, you will continue to have access to the MBK App for the remainder of your billing period.

25. If you signed up via the MBK App, to cancel your subscription via the MBK App, you must navigate to “Subscriptions” on your Apple ID account via settings on your mobile device. 

26. If you signed up via the website, to cancel your subscription via the website you must navigate to the “Profile” section and follow the prompts.

27. We do not offer refunds or credits for unused subscription periods, accidental purchases, medical conditions, or any similar reason or event, unless required by law to do so.

Governing Law

29. The laws in force in United Arab Emirates govern these Billing Terms.
